TERMS OF USE FOR POSTMATE

ACCEPTANCE OF TERMS
Welcome to PostMate! By accessing or using the PostMate mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the App. These Terms constitute a legally binding agreement between you and 20 Miles Ltd ("we," "us," or "our") regarding your use of the App.
USE LICENSE
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal or internal business purposes.
RESTRICTIONS ON USE
You agree not to:
* Modify, adapt, translate, reverse engineer, decompile, or disassemble the App or any portion thereof.
* Copy, distribute, sell, rent, lease, sublicense, or otherwise transfer any rights to the App.
* Use the App for any illegal or unauthorized purpose.
* Interfere with or disrupt the operation of the App or the servers or networks used to make the App available.
* Attempt to gain unauthorized access to the App or any related systems or networks.
* Use the App to create any product or service that competes with the App.
* Remove or alter any copyright, trademark, or other proprietary notices contained in the App.
* Use the App in a way that violates the rights of any third party, including intellectual property rights.
* Use the App to generate or disseminate spam or unsolicited communications.
* Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the App in a manner that sends more request messages to our servers than a human can reasonably produce in the same period by using a conventional web browser.
* Misrepresent your identity or affiliation with any person or entity.
INTELLECTUAL PROPERTY
The App and its original content (including but not limited to text, graphics, logos, images, and software) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You acknowledge that we retain all right, title, and interest in and to the App, including all intellectual property rights. You are granted a limited license to use the App as described above, but you do not acquire any ownership rights in the App.
USER CONTENT
You are responsible for any content you create using the App (“User Content”). You retain ownership of your User Content. By using the app, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content solely for the purpose of providing and improving the App. You represent and warrant that you have all necessary rights to grant us this license and that your User Content does not violate any third-party rights. You agree that we are not responsible for any User Content, and we do not endorse any User Content. We have the right, but not the obligation, to remove any User Content that violates these Terms or is otherwise objectionable.
DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION PROVIDED THROUGH THE APP. YOU USE THE APP AT YOUR OWN RISK.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT; OR (F) ANY OTHER MATTER RELATING TO THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO OR USE OF THE APP. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Your State/Province/Country without regard to its conflict of law provisions.
CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. We will post any changes to these Terms within the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
